Who is the appellate authority?
The ACT says that every state has to choose their own appellate authority and notify it. So in Gujarat it is the Social Defense Department’s Chief Secretary. It might be someone else in Tamil Nadu. So you will have to do your preliminary research based on where you live to find out who you should appeal to.
Sriraksha shares how she had to appeal to the same District Magistrate in Gujrat who rejected the card. He rejected it again saying there is no sex reassignment surgery yet. Then you look at who is supposed to be appealed to and then you can talk to them. Then we look at the case, draft an appeal and ask the transperson to file it.
There is no list of the name of officers who overlook this. You will have to search and find each states appeal authority yourself.
A lot of states have still not notified.
There is another issue that the review must be done within 90 days but there is no timeline for the appeal. So these small issues become a big problem in getting the TG Card.
Where should the District Magistrate be from?
According to the TG AcT, the District Magistrate must be from your territorial jurisdiction. Say someone lives in Ulsoor in Bangalore then that area coupled with Shivaji Nagar and Infantry Road would become one territory and go under the District Magistrate.
You also need to check the Police Limit and the District Magistrate can help guide you there. If you go to a court and tell them that you live in an area and you are looking for the District Magistrate then they will let you know.
You can simultaneously apply online to make it easier. Some people do it both online and offline and you have to go check on it constantly.
This is hard work. There is no dedicated list of this and you will have to keep asking. Even though there is legislation that mandates on this, this has still not been achieved.
