What has CLPR done for Transpeople ?
CLPR has a Trans Law Cell that works for Trans people. But what work does it do exactly? What cases does it get involved in? Advocate Sriraksha V Srivastava explains.
Trans-Law cell CLPR
CLPR’s Trans-Law cell provides crisis intervention. For trans people going through a tough time, CLPR brings its help to them and makes sure that justice is provided to the entire community.
Cases that CLPR has fought for Trans people
Sriraksha mentions a few cases that the Trans law Cell has fought for the justice of Trans people.
1. The first case she mentions is Jeeva vs the State of Karnataka – In this case, a Trans person was denied to get their educational documents changed to their name and gender. This triggered CLPR to file a petition against the school. Thanks to the petition the school was directed to change the name and gender in the educational documents. In addition to that, there was a change in policy. Karnataka Government released a circular stating that if a trans person demands a change in the name and gender in their certificates, you have to do it. Whether it be PUC documents or SSLC documents you need to change the names. The authorities can check the documents and see if there is a need for a court decree.
This case was a landmark because nothing like this existed before that.
2. A recent case of a central Government Employee was taken up by the cell. The employee complained that the employee service report wouldn’t change her identity- even though she identifies as a transwoman and has presented her case.
3. CLPR has also represented Transpeople who have survived sexual assault in cases in front of trial courts or the high court.
4. There have been notices sent to renters who have denied giving back security deposits merely on the basis of the person’s gender identity.
So, these are some examples of cases that the Trans Cell of CLPR has fought for justice for trans individuals and the community as a whole.
