Gender Marker and Name change paperwork

Hey!
I’ve a GD certificate and am gonna start off w HRT, so could get that certificate. I haven’t undergone SRS. I’ve gotten in touch w an agent for name and gender change in documents via Gazette method. Can I change the gender marker from M to F on documents? Is the GD certificate sufficient for the same? Adding on, when I apply for a passport, it’ll be a fresh & new one, since there’s no old one. Can I get it marked as F, after the documents are updated? Or is a SRS document necessary? Would it be a problem in future to have the documents marked F, without having undergone SRS, let’s say in immigration and stuff? Could somebody elucidate?

tara______ As per Transgender Persons(Protection of Right) Act, 2019 you should change documents with help of TG certificate / Revised TG certificate. This certificate you can get before SRS. SRS not necessary to get Revised TG certificate, only medical intervention required.

I watched Trans India’s Youtube video in which Advocate Sriraksha said the Gazette method could work as well. Both trans ID and the Gazette run parallel. However, if one registers for the trans ID online, on the registration form on the website, do they write deadname or preferred name? Could you also share the link to the screenshots you have shared?

tara______ create login ID on portal by preferred name and in application form they used both name.

you can change your all documents based on revised TG certificate in which mentioned F or M.

Kamlesh So u suggest now I get the trans ID which has T and then change the documents like Aadhaar and academic reports to T accordingly and then in future get the trans ID revised and change the documents to F?

first step - get TG certificate
2nd step - get revised TG certificate ( where F or M )
3rd step - update Aadhar (Name, Gender, Bio-matrix (Photo))
4th step - change pan card based on aadhar

after that you may start to change your all documents based on your new Aadhar & Pan. even your Academic documents also will get change for that you need to apply in respective education board.

Kamlesh There is no need for the first step. You can directly get the binary marker! See my discussion threads for the affidavit format and details.

mizu um could u link the thread for me plz? and can one get F on documents + new passport without SRS? Cuz i’ve read news articles where they had to deal w passport fiascos and stuff cuz the officers demanded SRS certificate. Any hunch?

Then, for updating Aadhaar, PAN, etc. after that:

You do not need the gazette notification to update Aadhaar.

The gazette notification process is a legacy, outdated system.
It makes no sense to put yourself through that painful process now that there's a far smoother alternative.

mizu what do u suggest if i need the trans ID and the documents quick and cannot wait for 30-40 days? um would the Gazette method be quicker? the agent is charging around 10k INR and i thought that’s the standard payment; i mean if it’s gonna take shorter while, i honestly don’t mind, cuz i need the documents updated soon. also, on the other hand, how to directly get the revised trans ID w F marker?

currently you can get the gender marker F without going through SRS too and when you apply for passport if you ever held a passport you need to choose a document accordingly and in that too you can get gender marker as F but get lot of supporting documents for that like with the ID certificate issued by the DM update you Aadhar card then your voter ID, PAN Card, school certificates then go for passports because when so many documents already reflect you as a female nobody can do anything if you have gone under the knife or not

I just now went through the threads where you asked the question a Gazette is not necessary if you go that route its going to be expensive as well as you also need to publish in newspaper

go for the TG ID issued by the national portal with a medical doctors letter as medical intervention certificate and you can directly apply for female instead of Transgender marker

just make a affidavit to the same effect

currently regarding immigration each country has its own rules regarding recognition as well if you are going somewhere in Europe, US, Canada, Australia, New Zealand you won't have much problems but other countries you have to check the local laws as currently Russia does not recognise LGBQTIA so its going to be highly problematic there similarly there are few other countries

tara______ It could technically be faster but I believe not appreciably so.

tara______ you can update all your documents with single gazette notification & It will just pop up in a week or so after you apply.

But all you need is proper documents & if your new name is having surname / lastname you need your concerned DISTRICT MAGESTRATE sign.

It all depends on the state you are from .

In both methods, you need a sign from the DM and that's the main roadblock. So IMHO there is no merit in waiting for gazette notification and going through that painful process. You can also get TG ID done quickly if you visit the DM office and request them to expedite it. Further, they are obligated to issue it within 1 month, unlike in the gazette notification case (where there is no time bound AFAIK).
