Mysha As I have mentioned in my detailed post, publishing in National Gazette is far better than just having a certificate of identity especially for change of passport

Point 3:-
Application for issue of certificate of identity under section 6 or7:
Is it mandatory for a person to be tagged as transgender first.

Cant a person who has been evaluated by psychiatrist and physiologist and been on HRT more than a year get the SRS done and then apply for certificate of identity directly.

The rule says apply for certificate from DM and then after SRS reapply for revised certificate of identity.

Till date before bill/act came into picture trans person always changed gender directly, went from male to female or vice-versa officially, none had applied for a certificate and labeled them self as transgender first.

Procedure for issue of certificate of identity under section 6:
(1) The District Magistrate shall based on the application, the affidavit and the report of a psychologist of a hospital of appropriate Government....

My Point for discussion : Why does it just has to be a psychologist from Govt hospital. What about all privates psychologist who is well educated and well aware of the process and has evaluated many transpersons till date and clear them for SRS.

As i have already stated this current govt is dead against the community, so irrespective of whether a person has had any medical intervention, all of us have to go with tg id card first.People like me who have 4/5 ids in my desired name and gender too are confused and in jeopardy as well because the govt didnt even think along this line...so again ppl lk me vil b made to run from pillar to post to get dm certificate and yet again change all docs ?
Recommendations from undp,chlet, vidhi legal,Labia, clpr, stakeholders from community - every level consultation is happening. We are all wanting to b done away with the DM Step as its against NALSA.But unfortunately, GOI has introduced an act which is in stark contrast to NALSA judgement. So the rules which were framed to go with the flow, community and all others have highlighted few recommendations.I Can share community recommendation if you want in your email. Yes, not just Government, private docs -being suggested. Also, self identification is insisted so seeking psychologist report is against nalsa is being highlighted. But as @iamcapricious made it a point , as far as goi is concerned they might not consider any suggestions. The act is already challenged constitutionally by Swati Bidhan Baruah and HRLN. Hope the act goes ultravires...
